Areas of Practice

Family-based Immigration

Over the years, we have helped thousands of immigrants get their green cards as legal permanent residents, naturalize to American citizenship, or even claim their citizenship based on provisions of the law

American citizens have the right to sponsor their immediate relatives such as spouses, children, parents, sons, and daughters for legal permanent residency. They can also petition for their fiance/fiancees if they meet certain requirements.

Legal permanent residents can sponsor their spouses, children, and unmarried adult sons and daughters.

Children born abroad that have at least one US citizen parent can in some cases claim American citizenship as long as they and the parent(s) meet certain residency, legitimation, and legal requirements.

Business and employment-based immigration

We have experience helping people with visas such as H-1B specialty occupation workers, H-2B non-agricultural workers, L-1 managers or specialized knowledge employees, O-1 extraordinary ability, TN visas for Canadians and Mexicans under NAFTA or the USMCA, E-2 treaty trader or entrepreneur visas, B-1 athletes, business visitors, or domestic workers, J-1 au pairs and exchange visitors, R-1 pastors, priests, monks, and other fulltime ministers or religious workers, and various A and P visas for diplomats and professional athletes and performers.

Humanitarian immigration

A much maligned and misunderstood but essential niche of immigration, humanitarian immigration covers people seeking asylum due to well-founded fear of persecution based on a protected category such as race, religion, nationality, political opinion (actual or imputed), or membership in a particular social group.

Humanitarian paths also provide relief to victims of domestic violence from US citizen or green card holder spouses (VAWA), victims of crime (U) or trafficking (T), temporary protected status (TPS) for citizens of countries designated by Homeland Security, special immigrant juveniles or former interpreters who assisted the US military, and refugees who came here after waiting through years of vetting by the United Nations and the US government.

We have also helped immediate relatives of US active and veteran service members get parole-in-place .

Removal defense in immigration court deportation proceedings

The Constitution provides for due process for all persons in the United States, regardless of citizenship or status.

If you or your loved one receive a Notice to Appear in immigration court for possible removal or deportation, those are not cases that you should attempt to do yourself without the assistance of a licensed and experienced lawyer.

Jath and his team are currently undefeated in immigration court in multiple states. We have successfully achieved relief including termination of cases, prosecutorial discretion, asylum in immigration proceedings, adjustment of status, cancellation of removal, and other forms of relief for people who otherwise might be facing deportation.

We have won cases at the immigration court level, before the Board of Immigration Appeals, and at the federal circuit court of appeals level, one level below the Supreme Court.
